Advancing Justice Through Pre-Trial Processes into the Criminal Justice System in Pakistan

Abstract

The criminal justice system in Pakistan is evolving to integrate pre-trial processes, aiming to enhance fairness, efficiency, and legal transparency. This study has examined the incorporation of pre-trial mechanisms within Pakistan’s legal framework, taking insights from international best practices. The research aims to highlight the importance of structured pre-trial processes, reduce trial delays, and ensure the protection of defendants' rights. Analytical and suggestive research methods are employed, utilizing legal document analysis, case studies, and comparative assessments with system in Malaysia. The findings have suggested that pre-trial procedures, including plea bargaining and case management, can significantly improve case resolution efficiency and reduce backlog. However, challenges such as outdated laws and lack of legal awareness hinder progress. The study recommends legal reforms, capacity-building programs for judicial authorities, and enhanced legal aid services to facilitate fair and effective pre-trial procedures in Pakistan. These steps are crucial for strengthening the country's criminal justice system.
