From Tariffs To Tokens: Reimagining Wto Disciplines In The Age Of Digital Trade

Abstract

The rapid expansion of digital trade has fundamentally disrupted the tariff-centric foundations of the World Trade Organization (WTO), exposing structural gaps in its ability to regulate data-driven commerce. This study examines the growing mismatch between existing WTO disciplines largely designed for trade in tangible goods and the realities of digitally delivered services, cross-border data flows, and emerging token-based economic transactions. The purpose of the study is to assess whether current WTO rules, including the e-commerce tariff moratorium and services commitments under the GATS, are adequate to govern contemporary digital trade and to explore pathways for normative reform. Employing a doctrinal and analytical research design, the article analyses WTO agreements, negotiating texts under the Joint Statement Initiative on E-Commerce, and relevant scholarly commentary. The findings reveal that while the tariff moratorium has facilitated the growth of digital trade, it remains insufficient to address regulatory challenges relating to data governance, digital services, and tokenized assets. The study concludes that a reimagined WTO framework moving from tariff avoidance toward comprehensive digital trade disciplines is essential to preserve the relevance, legitimacy, and inclusivity of the multilateral trading system in the digital age. Digital trade has dramatically reshaped international commerce, challenging the WTO traditional tariff-oriented regulatory framework. As digital technologies ranging from cross-border data flows and e-commerce to emerging tokenized economic systems become central to global trade, WTO disciplines must evolve beyond archaic customs duties and commodities-centric norms. This article examines this transformation, assesses the limitations of current WTO rules, and proposes a conceptual path for integrating digital trade governance into the multilateral trading system.
